1. Acceptance of Terms

By accessing or using ETM Games, creating a Publisher/Advertiser account at dashboard.etmgame.com, or playing HTML5 games hosted on our servers, you acknowledge that you have read, understood, and agree to adhere to these Terms & Conditions and our Privacy Policy. If you do not agree to these terms, you must not use our services.

2. Description of Platform & Services

ETM Games (operated by VISION INFOTECH) provides a comprehensive digital gaming ecosystem offering:

• A library of hundreds of lightweight, cloud-optimized HTML5/Instant games across multiple genres (action, puzzle, arcade, sports, strategy, and quizzes).
• Monetization SDKs and white-label game hubs for digital publishers, mobile app developers, and website owners.
• Advertising delivery infrastructure for brand advertisers seeking engaged digital gaming audiences.

3. Account Registration & Security

To access publisher analytics, revenue tracking, or advertising campaigns, you must register for an account on the ETM Games Dashboard. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security of your password and access credentials.
• Promptly notify us at business.viztech@visioninfotech.net of any unauthorized access or breach of security.
• Accept full responsibility for all activities that occur under your account.

4. Publisher Program & Monetization Terms

If you participate in the ETM Games Publisher Network:

• Integration & Asset Placement: You are granted a non-exclusive, non-transferable license to embed ETM Games widgets, links, or SDK code into your approved app or website architecture.
• Revenue Sharing: Ad revenue generated from display, video, or rewarded ad placements served within ETM Games on your property will be shared according to your publisher agreement (standard rate up to 50% net ad revenue).
• Payout Cadence: Valid earnings are paid within 30 days following the end of each calendar month, subject to meeting minimum payout thresholds and valid banking/tax verification.
• Traffic Validity & Anti-Fraud: Fraudulent traffic, artificial impressions, automated bot clicks, self-clicking ads, or incentivized invalid traffic are strictly prohibited. ETM Games reserves the right to withhold revenue and terminate accounts violating anti-fraud standards.

5. Intellectual Property Rights

All software, game source code, graphics, brand assets, logos, user interfaces, SDKs, and content available on ETM Games are the exclusive property of VISION INFOTECH / ETM Games or its licensors, protected by copyright, trademark, and intellectual property laws.

You may not copy, reverse engineer, decompile, modify, distribute, or create derivative works from our games or platform software without explicit prior written authorization from ETM Games.

6. Acceptable Use Policy

When using ETM Games or integrating our services, you agree NOT to:

• Use automated bots, scrapers, spider tools, or scripts to access or extract game data or inflate engagement metrics.
• Bypass, disable, or tamper with security measures, ad placements, or digital rights management mechanisms.
• Deploy our HTML5 SDK on websites or apps containing illegal, hateful, violent, adult, or malicious content.
• Interfere with or disrupt server infrastructure, network bandwidth, or API endpoints.

7. Disclaimer of Warranties

ETM Games is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted, error-free, or virus-free operation of our games, servers, or SDK services across all devices or locations.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ETM Games, VISION INFOTECH, its officers, directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, or business opportunity arising from your use of or inability to use the platform.

9. Account Termination & Suspension

We reserve the right to suspend or terminate your access to ETM Games, the Publisher Dashboard, or API endpoints at any time, with or without notice, if you breach these Terms & Conditions or engage in unauthorized activity.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any legal action, suit, or proceeding arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat, India, without regard to conflict of law principles.

11. Changes to Terms

We reserve the right to modify or update these Terms & Conditions at any time. Any changes will be posted on this page with an updated "Effective Date". Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
